These Terms & Conditions apply to your use of the Top Furniture website and to purchases made from Art Wave Limited trading as Top Furniture (“Top Furniture”, “we”, “us”, or “our”). By using this website, creating an account, placing an order, or purchasing from us, you agree to these Terms & Conditions.

  1. Website Use

You agree to use this website for lawful purposes only and in a way that does not interfere with the security, availability, or proper operation of the website. We may update, suspend, or withdraw website features at any time. While we take reasonable care to keep the website accurate and available, we do not guarantee that it will be uninterrupted, error-free, or free from technical issues.

  1. Product Information

We aim to present product descriptions, dimensions, colours, materials, images, pricing, availability, and delivery information as accurately as possible. Minor variations may occur because of screen settings, photography, lighting, natural material differences, manufacturing tolerances, or supplier updates.

Before placing an order, please check that the product dimensions, access requirements, colour, material, and intended use are suitable for your space. For large furniture items, you are responsible for ensuring that the item can be safely delivered through doorways, lifts, stairways, hallways, and other access points.

  1. Pricing, Promotions, and Availability

All prices are shown in New Zealand dollars unless stated otherwise. Prices, promotions, product availability, and delivery charges may change without notice. Promotional codes, discounts, and offers are subject to their stated conditions and may be withdrawn or changed at our discretion.

If a product, price, promotion, or delivery charge is listed incorrectly because of an error, we may contact you to correct the order, offer an alternative, or cancel and refund the affected order where appropriate.

  1. Orders and Payment

When you place an order, you are making an offer to purchase the selected products under these Terms & Conditions. An order is accepted only when we confirm it, receive cleared payment, and the goods are available for supply.

We may decline, cancel, or limit an order where a product is unavailable, payment cannot be verified, delivery cannot reasonably be completed, there is a pricing or listing error, or we reasonably suspect fraud, misuse, or breach of these Terms & Conditions. If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item.

  1. Delivery and Collection

Delivery areas, delivery fees, estimated delivery times, rural surcharges, freight conditions, and special handling requirements are set out on our Shipping page and may vary depending on item size, delivery address, carrier availability, and access conditions.

Delivery timeframes are estimates only. Delays can occur because of stock availability, carrier capacity, weather, traffic, supplier delays, public holidays, or other circumstances outside our reasonable control.

You must provide accurate delivery details and tell us about any access restrictions before delivery, including stairs, lifts, narrow entrances, steep driveways, parking restrictions, apartment access, or items that require special handling. Additional charges may apply for difficult access, failed delivery, redelivery, storage, or special delivery arrangements.

Please inspect your order as soon as it is delivered or collected. If an item arrives damaged, incomplete, or incorrect, contact us as soon as possible with your order details, photos, and a description of the issue.

  1. Cancellations, Returns, and Exchanges

If you wish to cancel or change an order, please contact us as soon as possible. We will try to assist, but we may not be able to cancel or change an order once it has been processed, dispatched, specially ordered, customised, or prepared for delivery.

We are not required to accept returns for change of mind, incorrect choice, unsuitable dimensions, or access issues where the goods comply with the order and applicable law. Where we agree to a discretionary return or exchange, the item must be unused, undamaged, in saleable condition, and in its original packaging where reasonably possible. Delivery, return freight, redelivery, assembly, and handling charges may apply.

Nothing in these Terms & Conditions limits your rights under New Zealand consumer law, including the Consumer Guarantees Act 1993.

  1. Consumer Guarantees and Warranty

Our goods and services come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993 where that Act applies. These include guarantees that goods are of acceptable quality, fit for their normal purpose, match their description, and are delivered within the agreed or a reasonable time.

If a product has a fault or does not meet a consumer guarantee, we will assess the issue and provide an appropriate remedy, which may include repair, replacement, refund, or another remedy required by law.

Consumer guarantees do not apply to problems caused by misuse, incorrect assembly or installation by someone other than us, failure to follow care instructions, normal wear and tear, accidental damage, modifications, commercial use where properly excluded, or damage occurring after delivery or collection.

  1. Care, Assembly, and Use

You are responsible for using, assembling, maintaining, and caring for products in accordance with any supplied instructions and reasonable furniture care practices. Furniture should be used only for its intended purpose and kept away from conditions that may cause damage, including excessive moisture, direct heat, harsh sunlight, unsuitable cleaning products, or overloading.

  1. Business Customers

If you purchase goods or services for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by law. Any warranties, remedies, or limitations for business purchases will be those set out in these Terms & Conditions, the applicable product warranty, or any written agreement with us.

  1. Intellectual Property

All website content, including text, images, graphics, branding, layout, product photography, and other materials, is owned by or licensed to Top Furniture unless stated otherwise. You may view and use the website for personal shopping purposes, but you must not copy, reproduce, distribute, modify, scrape, or commercially use our content without our prior written permission.

  1. Privacy

We collect, use, store, and disclose personal information in accordance with our Privacy Policy and applicable New Zealand privacy law. By using our website or purchasing from us, you acknowledge that your personal information may be used to process orders, arrange delivery, provide customer support, manage accounts, prevent fraud, and communicate with you about our products and services where permitted.

  1. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, consequential, incidental, or special loss, loss of profit, loss of business, loss of data, or losses arising from website interruption, delivery delay, incorrect product use, or circumstances outside our reasonable control.

Nothing in these Terms & Conditions excludes, restricts, or modifies any right or remedy that cannot be excluded, restricted, or modified under New Zealand law.

  1. Events Outside Our Control

We are not responsible for delay or failure to perform where caused by events outside our reasonable control, including natural disasters, severe weather, transport disruption, supplier delays, labour shortages, accidents, network outages, government action, or other events beyond our reasonable control.

  1. Changes to These Terms

We may update these Terms & Conditions from time to time by publishing the revised version on this page. The updated version applies from the effective date shown on the page, unless stated otherwise.

  1. Governing Law

These Terms & Conditions are governed by the laws of New Zealand. Any dispute relating to these Terms & Conditions, website use, or a purchase from us will be subject to the jurisdiction of the New Zealand courts, unless applicable law requires otherwise.
